However, the charges can only be filed following the failure of a secondary confirmatory test. This test will typically involve blood samples and/or urine samples and will be what is used in court.

Cannabis does indeed stay in your system for quite a while. However, the roadside sobriety tests are designed to test for intoxication. Not to mention their instruments are programmed with a minimum threshold that is well above what you’d still have in your body after a few days away from smoking cannabis.
How do they measure the amount of THC in your blood?
Despite the new legislation, currently there is no device certified under the Criminal Code of Canada as a reliable and accurate instrument for measuring the amount of THC (the active ingredient in marijuana) in nanograms per 1 milliliter of blood. Although given the outline of the new legislation, there is every reason to believe that the government is actively looking to source one out.
